IMPLEMENTATION OF 3% TAX ON THE SALE OF MARIJUANA

As of January 1, 2017, Depoe Bay recreational marijuana retailers will be required to collect a 3% retail sales tax from the customer at the point of sale.  This will be in addition to the State’s 17% tax on recreational sales. 

If you do not expect to make retail sales after December 31, 2016 (e.g., you will operate as a medical marijuana dispensary only), please disregard this notice.

The City of Depoe Bay is in the process of entering into an Intergovernmental  Agreement (IGA) with the State of Oregon Department of Revenue (DOR) that would authorize the DOR to collect the 3% tax on the City’s behalf. The City fully expects that the DOR will begin collecting the 3% tax effective the first quarter of 2017.  All tax collected by the seller must be segregated and then remitted as required under the law.  The DOR shall supervise and administer the local tax on the sale of marijuana items in accordance with the IGA. 

The City’s 3% tax was presented to, and approved by, the voters of the City of Depoe Bay under Ballot Measure 21-173 at the November 8, 2016 General Election.  If you have questions about Depoe Bay’s recreational marijuana tax, please contact Depoe Bay City Hall at 541-765-2361.

The Depoe Bay Urban Renewal Agency (URA) is pleased to announce
the Agency’s Preservation, Rehabilitation, Development, and
Re-Development Incentive Program

The purpose of the program is to help improve the condition and appearance of buildings, to develop or redevelop land or buildings, encourage infill and re-use in the Urban Renewal Area, with the primary goal of improving exterior and interior conditions of public and private buildings or properties within the Urban Renewal Area. 

As a property owner of property that is within the Depoe Bay Urban Renewal District boundary, please be aware that the URA has established this grant funding program, thereby affording the opportunity to apply for funding to support an eligible project on your property.     

This round of accepting applications will open January 1, 2017 and close February 28, 2017.

DRAFT DEPOE BAY SIGN ORDINANCE

The Depoe Bay Planning Commission has drafted a new sign ordinance.  Prior to scheduling a public hearing to consider adoption of the new sign ordinance, the Commission seeks input from business owners, property owners, and the community. Public hearings to consider adoption of the draft sign ordinance are anticipated to be scheduled in February or March, 2017.

The draft sign ordinance relaxes some regulations while making other regulations more restrictive. A summary of the draft ordinance is provided here, and the entire draft sign ordinance may be reviewed here.

Public input is encouraged and may be provided as follows:

- Written testimony may be submitted to Depoe Bay City Hall; mailed to City of Depoe Bay, P.O. Box 8, Depoe Bay, OR 97341; or emailed to info@cityofdepoebay.org.

North Creek Water Reservoir Earthen Dam Project
Invitation to Bid

Sealed bids for the construction of the North Creek Water Reservoir Earthen Dam Project for the City of Depoe Bay, Lincoln County, Oregon (Owner) will be received by Mr. Brady Weidner, City Superintendent, P.O. Box 8 Depoe Bay, OR 97341 or at 570 SE Shell Avenue, Depoe Bay, OR 97341, until 2:00 PM Thursday, August 25, 2016.  Bids received after this time will not be accepted.

Bids will be opened publicly and read aloud immediately following the specified closing time.  All interested parties are invited to attend.  Subcontractor declarations must be submitted to the above-mentioned representative no later than 4:00 PM Thursday, August 25, 2016.

Scope of Work: Reline approximately 60 lineal feet of an existing lined corrugated metal drain pipe with new 24" HDPE locking joint pipe liner to prevent failure of the pipe and damage to the existing earthen dam. In addition to the installation of the new HDPE liner are modifications to the existing concrete headwall, dewatering of work zone, driving H-piles to support the existing dock structure, minor repairs to the dock, installation of a new knife valve, new gravel surfacing, minor clearing and grubbing and restoration.  All as required for a complete project as identified within the Specifications and as shown on the project Drawings.

The City of Depoe Bay is accepting sealed bids for the North Creek Reservoir Dredging project.  The project includes dredging approximately 2,000 cubic yards of sediment from the City’s North Creek impoundment reservoir, hauling and land applying the material at an approved landfill site.  No bid shall be received or considered unless the bidder is registered with the Construction Contractor’s Board as required by ORS 671.530.   All bids shall be in a sealed envelope clearly marked “North Creek Reservoir Dredging”.  Bids may be hand-delivered to Depoe Bay City Hall, 570 SE Shell Avenue, Depoe Bay, or mailed to City of Depoe Bay, P.O. Hourly wage is $11.00. Cascadia Subduction Zone Earthquake
Community Presentations

 

 

The Lincoln County Sheriff's Office has scheduled a series of presentations to provide baseline understanding about the potential effects of a Cascadia event on our communities, with recommended strategies and tips for emergency plans and kits. Depoe Bay's presentation is scheduled for June 22 from 6:00-7:30 PM at the Community Hall, 220 SE Bay Street.

Notice of Budget Meetings

 

 
City of Depoe Bay

A public meeting of the Budget Committee of the City of Depoe Bay, Lincoln County, Oregon, to discuss the budget for the fiscal year July 1, 2016 to June 30, 2017 will be held at Depoe Bay City Hall, 570 SE Shell Avenue, Depoe Bay on Tuesday, April 26, 2016 immediately following the Depoe Bay Urban Renewal Agency Budget Committee meeting which begins at 6:00 PM.  The purpose of the meeting is to receive the budget message and to receive comment from the public on the budget.  A copy of the budget document may be inspected or obtained on or after April 26, 2016 at Depoe Bay City Hall, between the hours of 8:00 AM and 5:00 PM, M-F.  This is a public meeting where deliberation of the Budget Committee will take place.  Any person may appear at the meeting and discuss the proposed programs with the Budget Committee.

A public meeting of the Budget Committee of the Depoe Bay Urban Renewal Agency, Lincoln County, Oregon, to discuss the budget for the fiscal year July 1, 2016 to June 30, 2017 will be held at Depoe Bay City Hall, 570 SE Shell Avenue, Depoe Bay on Tuesday, April 26, 2016 at 6:00 PM.  The purpose of the meeting is to receive the budget message and to receive comment from the public on the budget.  A copy of the budget document may be inspected or obtained on or after April 26, 2016 at Depoe Bay City Hall, between the hours of 8:00 AM and 5:00 PM, M-F.  This is a public meeting where deliberation of the Budget Committee will take place.  Any person may appear at the meeting and discuss the proposed programs with the Budget Committee.

Notice is hereby given that a public hearing will be held by the Depoe Bay City Council to consider amendments to the Depoe Bay Zoning Ordinance.  The public hearing is scheduled Tuesday, March 15, 2016 at 7:00 PM at Depoe Bay City Hall, 570 SE Shell Avenue, Depoe Bay, OR.  The City Council may take action at the hearing, or may continue the matter to a place, date and time announced at the hearing.


Summary of Proposed Depoe Bay Zoning Ordinance (DBZO) Amendments

A.  Section 3.410 Planned Development (PD):

1)  Amends the general approval process. Clarifies the Planned Development application process. 
2) Details land use application submittal requirements. Identifies specific submittal requirements for Planned Development land use applications.
3) Allows tourist accommodations with standards. Allows up to 15% of the total land area of a new Planned Development to have tourist accommodations (vacation rentals). 

B.  Section 4.030. Off-Street Parking:

1) Requires new multi-family and non-residential parking areas to have paved surfaces.
2) Adds parking space requirements for tourist accommodations in a Planned Development.
3) Adds a new subsection by which a building owner in the downtown area may permanently transfer ownership of a parking lot to the City. 

You are encouraged to attend the public hearings because revisions to the proposed amendments are possible.  The proposed amendments are available for inspection Monday-Friday, 8:00 a.m.-5:00 p.m. at Depoe Bay City Hall or on the City website at www.cityofdepoebay.org.  A copy of the proposed amendments may be purchased at a reasonable cost.  For additional information contact Depoe Bay City Hall at 541-765-2361.

Applicable Criteria:  This is a legislative matter and not a quasi-judicial one.  The City Council will evaluate the proposal in accordance with Depoe Bay Zoning Ordinance (DBZO) No. 24 (as amended), Article 9 Amendments, and when applicable, ORS Chapters 197 and 227.

Testimony:  Submit testimony in oral or written form.  Oral testimony will be taken during the course of the public hearings and time may be limited.  Written testimony may be submitted to the City of Depoe Bay, P.O. Box 8, Depoe Bay, OR 97341 or via email at info@cityofdepoebay.org by 5:00 PM on the date of the hearing.

The City of Depoe Bay is accepting applications to fill four expired terms on the Depoe Bay Budget Committee. City Budget Committee members also serve on the Depoe Bay Urban Renewal District Budget Committee. The Depoe Bay Urban Renewal Budget Committee has additional positions to fill.  Any elector of the City of Depoe Bay interested in serving on the City Budget Committee or the Urban Renewal Budget Committee may apply at Depoe Bay City Hall, 570 SE Shell Avenue, Depoe Bay. Please submit application by 5:00 PM, Thursday, February 25, 2016. The City Council will consider all applications received and conduct interviews of applicants at the March 1, 2016 regular Council meeting. City of Depoe Bay Local Contest Information:

  • Students who are residents of the City of Depoe Bay are invited to participate in the City’s contest

  • Entries must be submitted to the City of Depoe Bay (all entries become the property of the City)

  • The deadline to submit entries is 5:00 p.m., Friday, April 15, 2016

  • All entries received by the deadline will be reviewed by a review committee.  One winner will be selected for each category. 

  • The winners will be announced at the May 3, 2016 regular City Council meeting.

  • Prizes:  Winner of each category will receive $100.00 cash prize and lunch with the Mayor

Cash prizes are being provided by John & Talley Woodmark and the City, lunch with Mayor Mattila is hosted by the Sea Hag Restaurant.

  • The City will submit the local winning entries to the Oregon Mayor’s Association (OMA) for entry into the state level contest (state level entries become the property of the OMA) 

Oregon Mayor’s Association State Level Contest Information:

  • City will submit its winning entries to the OMA by their May 16, 2016 deadline

  • Statewide winners will be selected by a committee of OMA members

  • Statewide winners and their Mayors will be notified of awards approximately mid-June 2016

  • Prizes:  First place statewide winners and their parents will be recognized at an awards luncheon held during the OMA Annual Conference in Lincoln City July 21-23, 2016, where they will receive their prizes – an Apple iPad Air 2 tablet

The City of Depoe Bay is now accepting applications to fill two vacant positions on the City Council (Position #2 and #5).  To qualify to serve on the City Council an elector must have resided in the City of Depoe Bay during the twelve (12) months immediately preceding the appointment.  Any qualified elector of the City of Depoe Bay interested in applying for this position may pickup an application form at Depoe Bay City Hall, 570 SE Shell Avenue, between the hours of 8:00 AM and 5:00 PM, Monday through Friday, or call 541-765-2361.  Applications must be submitted at Depoe Bay City Hall by no later than 5:00 pm on Thursday, February 25, 2016.  The Depoe Bay City Council will be considering all applications and conducting interviews at the March 1, 2016 regular Council meeting.

City Hall is getting a long-awaited update of our municipal software the week of January 25. Staff will be spending most of the week in hands-on training to help us transition to the new software. To take the best advantage of the training time, City Hall will be open as follows:

Monday, January 25: open regular hours

Tuesday, January 26: open until 10 AM, then closed for the rest of the day

Wednesday, January 27: closed

Thursday, January 28: closed

Friday, January 29: open regular hours

The phone line will be forwarded to the answering service. We will periodically check the drop box by the front door, phone messages, email, and fax, and respond to urgent messages as quickly as we can.
